is one of the following scenarios:

First Choice: The kissing cousins. Danny told Charlotte that he wanted to go really fast to try and forget his problems. Maybe she let him drive or she drove. Let's say the speed limit on that road is 50 and they were doing 65-70. Jordan is at fault for distracted driving but the driver of Charlotte's car contributed to the accident by speeding.

Second Choice: Isaiah. He was acting squirrelly that night.

Third Choice: Someone else.
My prediction -It will be revealed that Jordan's memory was faulty. She is/was suffering a head injury. And got mixed up on the headlights and thought she veered when it was the other driver.
